Everything You Need to Know

Whether you sell your truck mid-year, suffer a total loss, or run under the mileage limit, one question always arises: Is there any way to get reimbursed for some of the Heavy Vehicle Use Tax (HVUT) you already paid?

In some situations, yes. You may be able to file a credit using Form 2290. But in other situations, you may need to file Form 8849 to request a refund directly from the IRS.

In this blog, we will cover everything you need to know about Form 8849, including what it is, who needs to file it, and when to use it.

What Is Form 8849?

Form 8849 is an IRS claim form, namely “Claim for Refund of Excise Taxes”. It is filed to claim refunds of federal excise taxes previously paid that became refundable due to later events.

Form 2290 is for reporting and paying HVUT, but it also allows you to claim certain tax credits for previously paid taxes. You can claim certain HVUT amounts on Form 2290 as a credit, or file Form 8849 with Schedule 6 to request a refund of eligible HVUT amounts reported on Form 2290.

For clarity, the same amount cannot be claimed both as a credit on Form 2290 and as a refund on Form 8849. Those are two separate entries.

Who should file Form 8849?

The person responsible for filing Form 8849 depends on the use case you are filing for:

1. Sold, destroyed, or stolen vehicle claims: The claimant is the person whose name is registered on the vehicle.

2. Low mileage and overpayment claims: The claimant is the person who paid the tax.

A tax professional may prepare/transmit the filing for a taxpayer, but the claimant is always the taxpayer eligible for the refund.

Where to File Form 8849?

Form 8849 can be filed physically or electronically. For physical filing, you must send your completed Form 8849 along with paper Schedule 6 (HVUT) claims to the Department of the Treasury, Internal Revenue Service, Cincinnati, OH 45999-0002.

In case of electronic submission, you can choose from a list of IRS-authorized eFile providers. eFile is much faster than paper filing, and you will receive an IRS receipt acknowledging that your return was accepted.

When do I File Form 8849?

Form 8849 claim must be filed within 3 years of the filing of the return to which the claim relates, or 2 years from when the tax reported on that return was paid, whichever is later. The standard HVUT filing due date is August 31st for vehicles used in July. Form 8849 is for HVUT-related claims; it may be used with Schedule 6 to request a refund for a highway motor vehicle reported on Form 2290.

If you sold, destroyed, or your vehicle was stolen before June 1 of the tax year, and you did not use the vehicle for the rest of the tax year, you can claim a refund. If the vehicle is low mileage, you can’t file Form 8849 until after the tax year has ended.

How is Form 8849 Connected to Form 2290

Form 2290 is used to file and pay taxes for the HVUT for the tax period of June 1st of the filing year to July 31st of the next year. Once the IRS accepts an eFiled Form 2290, your eFile provider sends you a watermarked Schedule 1 by email as proof of filing. On Form 8849 (Schedule 6), you claim a portion of that tax back if you meet certain criteria.

The following information must match exactly between both documents:

Name and EIN of the person filing

VIN (including all numbers)

Tax period you are filing for

EZ2290’s Form 2290 eFiling, Form 8849 eFiling, amendment filing, VIN corrections, bulk uploading for fleets, eFiling using the current Schedule 1, and auto-audit during the filing process helps reduce the rejection rate from the IRS.

Top 5 Common Events that Qualify You For a Form 8849 Claim

A Form 8849 claim may be used when HVUT was previously reported and paid on Form 2290 and later becomes refundable under IRS rules. Below are common situations in which you may be eligible to claim an HVUT refund on Form 8849, Schedule 6:

Vehicle sold before June 1 during the tax period and wasn’t driven

Vehicle was destroyed before June 1 and was not used during the remainder of the tax period

Vehicle was stolen before June 1 and was not used during the remainder of the tax period

Vehicle was used 5,000 miles or less during the tax period, or 7,500 miles or less for an agricultural vehicle

Make sure you record the event date, the vehicle’s VIN, and start putting together your supporting documents. Your claim must relate to the same Form 2290 tax period for which the HVUT was originally reported and paid.

Form 8849 Schedule 6: What the Filing Requires

When filing an HVUT claim, you’ll want to use Schedule 6. Pay close attention to using the correct schedule and entering accurate claim information, because errors can delay IRS processing.

The Schedule 6 claim requires:

Matching registrant name & EIN as shown on original Form 2290

VIN (Should be same the VIN as on the vehicle)

Tax period/date of claim and reason for claiming per instructions on Schedule 6

Calculate the credit amount as per IRS instructions.

While you need Form 2290 filing information & IRS-stamped Schedule 1 for any claim, here is a list of documents to keep ready based on your claim type:

Types of Claims

Mandatory Documentation

Sale

Bill of sale or other proof of title transfer

Destruction

Complete loss paperwork from insurance company and/or salvage certificate

Theft

Police report and insurance paperwork

Low mileage

Mileage log, IFTA documentation and odometer readings

How to File Form 8849: A Complete Guide

1. Review eligibility requirements for the type of Schedule 6 claim you are filing.

2. Make sure you complete Schedule 6 in its entirety and record the credit you calculated.

3. Attach documentation that applies to that specific type of claim.

4. Mail this to IRS Cincinnati, OH 45999-0002 or eFile using an IRS-approved eFile partner.

5. Make sure to keep a completed copy of your filing package with the confirmation of your filing.

If you filed Form 2290 with EZ2290, you can access your previous returns and copies of Schedule 1 from your account.

Avoid These Mistakes When Filing Form 8849

You can help reduce the risk of IRS processing delays by avoiding these common filing errors:

Selecting the incorrect schedule based on the type of claim

VIN does not match what was originally submitted on Form 2290

Incomplete mileage records for a low-mileage claim

The tax period and event date were reversed

Claimed an estimated refund amount instead of calculating the claim amount

Electing to file a low mileage claim before the tax period has closed.

Trying to claim an amount that has already been credited to you on Form 2290

Always double-check that your schedule and claim details, including the VIN and tax period, match the original Form 2290 information before you file Form 8849.

Real-Life Examples and What to Do

Scenario

What Happened

What to Do

Sold truck before June 1

Sold prior to June 1, and taken out of taxable service. Once completed, file Form 8849 with the same information.

FAQs

1. Can you file Form 8849 without a Form 2290 on record?

For HVUT-related claims, Form 8849 must tie back to HVUT reported and paid on Form 2290 for the same VIN and tax period. Without a corresponding Form 2290 filing, there is no HVUT refund to claim. However, Form 8849 may still be used for other types of excise tax refunds not related to HVUT.

2. Can one Form 8849 cover multiple vehicles?

Yes. Under Schedule 6, you can include multiple vehicles in a single filing. Each vehicle (VIN), tax period, and claim reason must be listed separately and supported with accurate details.

3. What if the VIN on Form 2290 does not match the claim?

A VIN mismatch can delay IRS processing of the claim. Correct the VIN on Form 2290 before submitting the Form 8849 claim so the records match.

4. How long does the IRS take to process a Schedule 6 claim?

IRS states that electronically filed Form 8849 claims with Schedule 6 are processed within 45 days of acceptance. Paper processing times can vary.

Whether you sell your truck mid-year, suffer a total loss, or run under the mileage limit, one question always arises: Is there any way to get reimbursed for some of the Heavy Vehicle Use Tax (HVUT) you already paid?
