IRS Form 2290 Amendment

Submitting Form 2290 to report and pay heavy vehicle use tax for vehicles weighing 55,000+ pounds doesn’t always go the way you want it to. There are certain instances where a previously filed HVUT return may need to be updated and corrected, that’s where Form 2290 amendments are required.

In this blog, we will walk you through the complete Form 2290 amendment process and how you can stay on top of your HVUT compliance.

Understanding The Basics of Form 2290 Amendment

What is Form 2290 Amendment and Why Is It Needed?

Form 2290 amendments are required if there has been a change in the reported information. Anytime there is an increase in the taxable gross weight of the heavy vehicle than what was originally reported or a tax-suspendedvehicle exceeds the mileage limit (5,000 miles for regular vehicles and 7,500 miles for agricultural vehicles), you can file a Form 2290 amendment to correct the previously filed Heavy Highway Vehicle Use Tax return and pay the additional HVUT due for that tax period. Incorrect VINs can also be corrected, but they require use of a separate checkbox.

Making these modifications to your previously filed Form 2290 ensures that the information reported to the IRS is correct and is compliant with HVUT tax reporting requirements.

Types of Form 2290 Amendments & Corrections You Can Make

1. Taxable Gross Weight Increase

If a heavy vehicle that was previously reported had modifications, that increased its taxable gross weight during the tax period, it would require a Form 2290 weight increase amendment. For this correction process, you need to make the changes, pay the additional tax for the remaining months after the weight increased, mention the month the weight increased, and file it on or before the last day of the month after the change happened.

2. Suspended Vehicle Exceeding Mileage Limit

Any tax-suspended vehicles (vehicles that are reported as suspended on Form 2290/Schedule 1) that exceed the mileage limit of more than 5,000 miles for regular vehicles or 7,500 miles for agricultural vehicles are required to pay and report HVUT tax. This update has to be mentioned in an amended Form 2290, and the tax has to be paid starting from when it was first used that year.

3. VIN Correction

If a previously filed form had the wrong VIN, you can file an amended return to change the incorrect VIN by checking the “VIN correction” checkbox. There is no need to pay additional tax for this correction. Just add an explanation of why the VIN needed to be corrected and be sure to use the Form 2290 for the tax period you are correcting.

Note: Amendment is not allowed for reduced weight during tax period (non-refundable) or credits for sold/destroyed vehicles (use Line 5 on new return).

Deadline for Filing Form 2290 Amendments

Form 2290 amendment deadlines usually fall on the last day of the month following the month when change occurred.

For example: If the taxable gross weight of the vehicle increased on July 1, a Form 2290 amendment must be filed by the last date of the following month, i.e., August 31.

Failing to file or pay on time can trigger penalties and interest. You may be required to pay a late filing penalty of 4.5% per month (up to 25%), a late payment penalty of 0.5% per month (up to 25%), as well as additional interest on the unpaid tax.

For Mileage Exceeded (Line 2): Calculate the tax owed using the tax computation table based on the vehicle’s original month of first use.

Scenario 2:

If your suspended vehicles exceed the low-mileage threshold of 5,000 miles travelled, the vehicle qualifies as taxable and must be reported. You’ll need to file a Form 2290 amendment from first use month.

Scenario 3:

If your Schedule 1 VIN doesn’t match the vehicle details, you’ll need to file a Form 2290 VIN correction amendment with the correct VIN and mark the checkbox that mentions “VIN Correction”. Once the IRS accepts the amended return, you’ll receive your stamped Schedule 1 within minutes
